1. Who we are
Bench'd ("the Service") is provided by Elite Sporting Technology ("we", "us", "our"). By creating an account or using the Service you agree to these Terms.
2. Acceptance
Your continued use of the Service constitutes acceptance of these Terms. If you do not agree, do not use the Service. You must be of legal age in your jurisdiction or have authority to bind the organisation you represent.
3. The Service
Bench'd helps Australian football coaches and clubs manage rosters, positions, rotations, match stats and reports. Specific features depend on the plan you select.
4. Acceptable use
You must not misuse the Service. In particular, you must not: (a) use it unlawfully or fraudulently; (b) send spam or infringe intellectual property; (c) probe, scan, scrape or interfere with the Service's security or infrastructure; (d) upload malware; or (e) attempt to reverse engineer, resell or circumvent technical limits.
5. Accounts
You are responsible for the accuracy of the information you provide and for keeping your credentials confidential. You are responsible for activity under your account.
6. Intellectual property
We retain all rights, title and interest in and to the Service, including software, documentation and branding. You are granted a limited, non-exclusive, non-transferable right to use the Service within your selected plan.
7. User content
You retain ownership of content you upload (rosters, stats, notes). You grant us a limited licence to host and process it solely to provide the Service.
8. Payments, billing and subscriptions
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation and refund mechanics are governed by Paddle's Buyer Terms. See our Refund Policy.
9. Service availability
We strive to keep the Service available but do not guarantee uninterrupted or error-free operation. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
10. Suspension and termination
We may suspend or terminate access for material breach of these Terms, non-payment, security or fraud risk, or repeated policy violations. On termination you may export your data for a reasonable period before deletion.
11. Liability
To the extent permitted by law, our aggregate liability is capped at the fees you paid us in the 12 months preceding the claim. We exclude liability for indirect, consequential or special damages, including loss of profits, data or goodwill. Nothing limits liability for fraud, death or personal injury caused by negligence where such limitation is prohibited.
12. Indemnity
You agree to indemnify us against claims arising from your content, unlawful use of the Service or breach of these Terms.
13. Governing law
These Terms are governed by the laws of Australia. Disputes are subject to the exclusive jurisdiction of the Australian courts.
14. Changes
We may update these Terms from time to time. Continued use after changes are posted constitutes acceptance.
